(1) An establishment established for the purpose of earning profit under the ownership of the Government of Nepal shall set aside an amount equal to five percent of the net profit earned by it for each financial year as a bonus.
(2) Notwithstanding anything written in sub-rule (1), the monopolistic establishment established in the area designated by the Government of Nepal for the purpose of earning ownership profit of the Government of Nepal shall set aside an amount equal to one percent of the net profit earned by it for each financial year as a bonus.
(3) The establishment owned by the Government of Nepal must obtain the approval of the Government of Nepal, the Ministry of Finance before distributing the bonus, and after receiving the approval, the information must also be given to the relevant labor office.
(4) When seeking approval according to sub-rule (3), in addition to the details written in sub-rule (2), the following additional details must also be submitted. (a) Payment in the next year according to the expenditure placed on the profit base (5 acre basis): statement of the expenditure incurred and the basis for its verification,
(b) Statement of contingent liability (contingent liability) up to the financial year in which the statement is submitted and proof of having set up a separate fund for the same. , warranty, guarantee, accumulated loss, tax liability, bills to be paid, liability for facilities to be paid when the employee is on leave according to the staff regulations, as well as the amount adjusted to the prevailing interest rate in the international market.
(c) The details of repayment of principal and interest of the loan secured by the Government of Nepal as per the schedule mentioned in the contract issued at the time of taking such loan.
(5) Notwithstanding anything contained in sub-rules (1), (2), (3) and (4), an establishment established for the regulation, promotion and development of any sector owned by the Government of Nepal without the purpose of making profit shall receive bonus bThe amount received cannot be allocated.
(6) If an establishment owned by the Government of Nepal distributes bonus in violation of this rule, the bonus distributed in such manner shall be recovered from the authority making the decision regarding the distribution of bonus, equal to the government balance.
